Title: STOOOPID Mail carrier!!!!!
Description: Maybe need some advice, too...

Honey - January 9, 2008 10:59 PM (GMT)
So I go out to check our mail, like every day. We got one lousy letter. :booyah: So as I turn it over to rip it open, I see the mail lady has left a note ON THE LETTER!!! It read something like, "Your dog was on the road today and ran into the side of my car. The passenger door has sustained heavy damage. I will be going to the police to file a report." Then she signed it.  :screwy:

First of all, yes our dog was loose as the kids had been outside playing with him 'cause he needs exercise and such and it's not everyday he's loose.
Second: I can't even remember the last time he even attempted to chase ANY vehicle, especially not the mail lady! In fact, hers was one he would never, ever chase! Why all of a sudden now?? Doesn't make sense.
Third: IF as she claims he hit her car and he left "heavy damage", why didn't she come to the door to tell us?? Our house was exceptionally quiet today as Candace was not feeling well and the tv was turned down lower than usual. NObody heard any knocking, let alone yelping which SHOULD have come from the dog if it was oh, so bad. Our house is quite close to the road and we hear and feel every vibration of each vehicle/horse/buggy that goes by.
Fourth: I'm checking into this one...but isn't it like, ILLEGAL to be defacing someone's PRIVATE property? As a postal worker, she should be using her own notepad for such notes!! DUH! Having strong thoughts about calling up her manager. (?)

What I have done so far, is given the dog a good rubdown to see if he's tender to any areas in the head, neck and shoulders. Nada. He was quite playful and sat very nicely while I talked to him and gave him a good rubbing. Hubby obviously knows about this and is actually unsure with what to do. I'm thinking he wants to do nothing and let it go. I'm thinking we need to do something. Tomorrow, when the mail lady comes, I'm going to wait outside and ask to take pictures of her so-called "damage". If she has a problem with this, then I KNOW she's lying.

Any advice from you all-brainy folks?

Keneke - January 9, 2008 11:34 PM (GMT)
Oooooooooooooooooooooooooo...you're in TROUBLE....

Ok. Got that out of the way...
I'm not sure how it works in Canada...
I know here a dog MUST be on a leash in public, no exceptions (other than a dog park) and if something happens w/ the dog in public, owners are USUALLY responsible BUT the person who was harmed would have to prove it (pics like you mentioned).
I do also know that a mail carrier doesn't have to deliver mail to a home that has a dog that is threatening. They can skip the house if need be...

Honey - January 10, 2008 12:02 AM (GMT)
Well, before throwing "you're in trouble" around, we need actual proof. If she can't come up with pics or let us see the damage or let us take pics, she has no proof. So we're not "in trouble" yet.

The other thing. She wrote on our letter, isn't that illegal in the States?

hope4today - January 10, 2008 12:35 AM (GMT)
Ok, you mentioned possible advice so this is what I reckon.....

Even though you're mad, I would play this really cool and keep it as low key as possible. If you ring and just go mad, it will ikely just become a stand off to see who will win.

I would probably wait till I had cooled down a bit and then call the police, explaining what has happened (with a 'co-operative' attitude) and ask what your rights are. Depending on what they say, I would probably then call the Postal Manager (still co-operatively).

Let them know you have checked your dog and it has no damage or injury. That you didn't hear anything at all and the dog has given no indication of pain. Under these circumstances it seems it could not have been your dog who did the damage. Neither do you understand why the postal servant didn't either call out or come in to advise you since they were still able to deliver the letter.

Then suggest that maybe another dog may have been involved.

If they insist that your dog did it, then say you willl require proof of the damage, that you will also go to the police (still all co-operatively) to report your side and get advice and your rights. You could also let them know you will go to a vet to have the dog examined and gain proof that your dog could not have run into a car and damaged it.

You can also ask why your letter was defaced by the postal lady. ( Keep it as evidence).

If it gets this far, then ask the police what your rights are, as you don't believe your dog was involved. I would document it all ( in case it is needed later), and put it in writing to the PO if it goes this far, advising what you'll be doing and also advising that if it is shown that your dog was not involved you will be expecting reimbursement of the vet cost. This will depend on what the police say your rights are.

I know that's long but the essence of it is to tell your story in a calm manner to hopefully get some co-operation out of them rather than a stand off.

Just my initial thoughts - may or may not be the way to go, over there

I jes got up agin, but how pathetically sad... sorry.. I hate ppl an I hate this world... everone tryin to git sumthin that isn't thiers... first thin I would do is call the police an have them come an do a police report, show them your dog, show them the dog has no obvious sign of injury, inform them that you did not witness the incident as is claimed by the mail lady and git your side of everthin you can documented right now, if you have only the one dog an someone else can verify that it is the only dog you have an it's not injured, it's a pretty done deal in my opinion.

Dogs like anythin else do not survive well when they smash into sumthin causin extreme damage. I think it's a load of crap, but git a police report on it wit your side of everthin in the event it does git into sumthin bigger, an you can call the manager of the mail person an complain bout writtin on your letters as well. Here that's a no no, anymore ppl probly jes don't care but it's still a no no an if it's a no no there then she needs to have a talkin to. But git it verified that your dog is fine an it was in no way responsible for the incident.

There's no such 'law' here bout havin dogs on a leash... this is private property as I would imagine is yours. Now if the mail box is out on public road etc an the dog was there, then here any livestock on the road that causes damage is the owners responsibilty to fix, you'd be surprised how many people convenitely lose thier live stock when involved in an accident hehehe

I'd love to see this massive damage as well, because I would imagine if it's that bad, your dog would be injured an if it's that bad an he's not, it wasn't your dog that did it, that much is for sure.

An uh.. hehe I agree wit Hope as well. But I would insist on gittin the police report done now, it doesn't cost anythin for you to do it, might cost to pick it up if need be, but git it verified by a third party ie the police man that way you can show not only your word, but that of the police man as well.

I'm in agreement with Hope and the pukey one (NOT Squat, A2J :P ).......

Be co-operative but I'd also get the police out right away to do a report, take a look at the dog & document that he's not harmed in any way.

If he'd done SO MUCH DAMAGE to her car, then he'd have some bumps or bruises on him.

And yes, I think it's illegal (or at least IMMORAL) to write a note on your personal mail! Not to mention, WHY didn't she come up to the house as soon as it happened? Or if she was scared of your dog, honk her horn until you came out.

stooooopid......... :nono:

Honey - January 10, 2008 12:34 PM (GMT)
That's just it. She didn't even pull in our driveway to honk or anything. I would've heard it for sure. Personally, I think she's just blowing smoke...we'll see what happens today. I might call up an officer and have him come check our dog. Cops should know dogs, right?

Our mailbox is across the road. So it is on township property. Hubby's said we might pay for her "damage". We are insured.

Waiting to see how this drama unfolds~ :D

rasplundjr - January 10, 2008 02:51 PM (GMT)
Dog ran into the side of her car and caused massive damage? What the hell is she driving a yugo?

What kind of dog?I can see maybe a lab, shepard, rotweiler etc being able to cause "massive damage" running at vehicle (which is the only way I can see the dog damaging the side of her car)... but most other breeds either aren't really meaty enough to do any lasting damage, nor fast enough to build up the momentum to do "massive damage".

Meh I bet she was on a bender at lunch and opened the passenger door on a telephone pole.....

Honey - January 10, 2008 03:02 PM (GMT)
He's a medium sized mutt. Heck, I had a dog twice the size of ours run into my car....not a dent, scratch, nothin'. Dog was a bit dazed, but fine.

Yesterday was also a windy day. I bet something else rolling around banged into her car but she figures the dog is a more "convenient complaint"....who knows. This is an I-won't-believe-it-til-I-see-it kinda thing.

Oh, and as per "hubby's commands" he doesn't want me to call ANYone. If any phone calling is done, he will be the one to do it. This could take a while....:bored:

sf49erfan - January 10, 2008 03:41 PM (GMT)
I don't know anything about the mail service in Canada, but here in the States the mail service has thousands of mail trucks. there is a good possibly that they drive a different one each day. So she might not have the same vehicle today that she had yesterday.

Honey - January 10, 2008 04:12 PM (GMT)
She's been driving the same tin box for the past 2 years. All I know is it's blue and has the mail sign on top and the orange flashy light. I'll find out the make of it today. :guns:

rasplundjr - January 10, 2008 06:07 PM (GMT)
Some of the mail services here in the states have you use your personal vehicel and expense it, my parents mail carrier just finally got an actual one fromt eh gov't maybe 4 or 5 years ago.

Honey - January 10, 2008 06:20 PM (GMT)
Well, she pulled up today with the same car. Allowed me to take pics and informed me that she will get in touch with her insurance company. Sounds like we're S-C-R-E-W-E-D. She admits she was very surprised that it was our dog since he's never ON the road. She expressed concern for the dog, too. So far, no police have called us to check on things. Cops had asked her how the dog was after he was hit. He seemed dazed and then mad and started barking like crazy at her as she left. Apparently she HAD been here, waiting for us to come out. :dunno:  Oh and I did apologize for the dent. It does seem rather BIG and I saw a scratch with paint removed. Not likely a dog's head mark? Unless it's a claw mark? I'll post pics later so y'all can judge for yourself.

Blah, I just want this over and done with. After this dog, NO more dogs. Cats are much better anyway. If they get flattened you can get another. No such thing as "loyalties" or crap like that with them. In fact, we've already decided to get Candace one for her birthday in April....:shh:

Lena.... I could have swore you told me your husband didn't like anyone playin wit his butt..... can you PLEASE tell me why any time sumthin goes fowl the boy rolls over an takes it right straight up the ass????

NO frickin dog that I have EVER hit, an I have bounced em from the front, clear over the top an laid em out in the bed of my truck has EVER scratched the paint ANYWHERE! This is complete crap! Not to mention... while the dog COULD have been dazed... they WILL NOT I mean will NOT!!! sit there an start barkin like they are mad... what frickin planet is this jackass from?? The dogs run off... if they are hurt bad enough they'll run off an hide an die... if this dog of yours did this kind of damage he'd be dead by now, it's that simple, I mean it does NOT take much to injure an animal to the point of death because of stress, stress kills more animals then anythin else. This is a complete load of crap. I would have definetely had the police do a police report, had the dog checked at the vet an git some confirmation that no way in hell did your dog cause this, er is in anyway responsible.

This is frickin crap... please post the pics, I wanna see what type of vehicle it is an then I'll tell you wether er not your dog did this "masssive" amount of damage.....

I'm gittin pissy jes thinkin bout this......

andiesmama - January 10, 2008 07:53 PM (GMT)
I agree with Louis...........if your dog had done that huge dent AND scratch, he wouldn't have sat there & barked at her, he would've yelped & run off and there's STILL the matter that you checked him out & he wasn't tender at all, I would think he'd have a bump or bruise or something.

 :pepsi:

Honey - January 10, 2008 08:17 PM (GMT)
Thanks, A2J. Squat, you are just evil. Thanks for your support. :lena:

What I'm still waiting for is her so-called "proof". She says she saw him lying on the road. Where's her proof in all this? Then he got up, barked at her then ran back into the fence and she saw him running in the fields. INJURED animals don't run. Isaiah's been playing with him and he plays ROUGH. Dog is fine. No tender spots. Nothing. And aren't professional people out driving supposed to carry a camera in the vehicle at all times? Can she provide pictures of my dog lying on the road? Speaking of pics...mine are uploading now.

I wonder if the insurance company will even do anything about this. Yes, we have insurance, but from what I recall there is no PROOF, so there's basically no case, right? Lady's blowing smoke.
I've yet to hear from any police. Nobody's called and nobody's shown up.

Ok - not a dog person here but I can't imagine a dog making such a big dent...A bull, yes. A dog, no.

There is NO WAY a dog did that!! She will be laughed out of court. And no way your dog could have done it. She is lying. I'd be telling her that you'll be reporting her for fraud.

She has banged up that car and is looking for a way out.

Oh and don't apologise to her for the dent again.. that can be seen as an admission of guilt.

JMO

:wall:  :screwy: :boo: :bonk:

Rocco did NOT do that to her car!! PUH leeze! He would have to have been pretty banged up himself to have caused that big of a dent.

She's lying........

Honey - January 11, 2008 01:52 AM (GMT)
Yep! Exactly what I think. Thanks for your backup, guys. One thing I have to do yet is check his metal collar ring for blue paint. I hadn't thought of that until hubby brought it up.

I just chatted with a sister of mine who's had plenty of insurance experience just recently. Even if she did file with the police, nothing will come of it because the dog didn't bite her. She didn't come to the door or honk her horn which we would've heard to notify us IMMEDIATELY, so it's a hit and run from the scene of the said "accident". Her insurance company can't bother us about it anyway. It's no fault car insurance. They pay for the damages that she claims and she pays higher premiums. It's all on her and nothing on us. And as for the police, they can't charge us with anything because she has no proof, so all they're going to do is laugh after she leaves because she doesn't have a legit claim to press charges. The worst that can happen is she can file a lawsuit that will probably cost her more than it's worth. So she probably won't do it unless she's really, really dumb . <~ best statement since this has all gone down.

I am also not going to apologize anymore. We have nothing to be guilty of. We've done nothing to her personally.

Honey - January 11, 2008 07:50 PM (GMT)
UGH! This has been one helluv an experience. :wall:

So HER insurance calls me and asks if I claim liability. Well, no because there is no proof. Stupid ass says, "What, do you want somebody to stand by and take pictures of your dog getting hit?" I told him that there were NO other witnesses, except the mail lady. And even so, a dog our size could not make a dent in her door like that! So he says, so you're not claiming liability? Duh, NO. There's been no police report and nobody's been here to check our dog after the so-called incident. So ok. He says that they will mail us a report and a letter from them. I was forewarned by dad whom I talked to before I called this clown back that if he does the insurance jargon and talks real fast, just hang up. Wow, I didn't get that. :faint:

So, now we'll wait for letters. My hands were like, shaking the entire time. Talk about nerve-wracking!!

He used the word "claims" alot, too. Well that's all it is. Just a bunch of air-borne "claims".

Somebody get me a coffee.

Stringaling - January 11, 2008 08:31 PM (GMT)
If she wants you to pay, why would she call her insurance company? Wouldn't she need to file a claim with your insurance?

andiesmama - January 11, 2008 08:35 PM (GMT)

She's :screwy:

Honey - January 11, 2008 08:44 PM (GMT)
Yeah. :screwy: is TOTALLY correct. :D

I believe we would have to accept liability before we swap insurance numbers. Honestly, and as you can see by the pics I've posted, our dog did not do this. This was something entirely different. Another thing about the pics. If it had been our dog, that DENT would be CLEANER than the rest of the car. It isn't. It's just as filthy as the rest and must have happened earlier than the day she "claims".

I had talked to my dad and told him everything over the phone. I feel SO much better getting that insurance thing over with. In fact, the insurance dude was very eager to get off the phone. :D Yay me! I can pester quite nicely! :thanks:

My other "issue" is hubby. HE feels guilty. I've ran this over by him so many times now and he still wants to go to the shop down the road to see how much it would cost to take a dent out of a car. I'm like, NO! She's got no proof, so there IS NO CASE!!! It's very easy to put a guilt-trip on him. What do I do? I've talked and talked and reassured him...we're gonna be fine. WE are not in trouble. Just that ditz will be. I think I need him to talk to my dad. Dad's good at reassuring. He helped me alot today.

Stringaling - January 11, 2008 11:12 PM (GMT)
Yeah, hae your dad call him.

No. You always go with your insurance and they usually work w/ the other persons insurance etc.
I wouldn't have even spoken to her insurance rep. I would have my insurance company handle it.

Honey - January 12, 2008 03:06 AM (GMT)
Well, what's done is done. I can't go back and delete the convo. :P Besides, now he's heard MY side of the story! Which was pretty dumb when he said, "There's 2 sides of the story now...." DUH, there's usually 2 sides to EVERY story! What a ditz. :screwy:

Honey - January 12, 2008 06:00 PM (GMT)
Last night when I told hubby that the lady's insurance company called and I'd talked to the guy, he got this huge look of relief come over him. :D Far as I can tell, this is all settled and we shouldn't have any problems. But if it's a fight they want....bring it. :box:

NOT!
